Terms of Service

1. Use of the Service

You may use the Service solely for personal, non-commercial purposes. You must be at least 18 years old or have the permission of a parent or legal guardian to use the Service.

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Submit content that is offensive, harmful, or infringes on others’ rights
  • Interfere with or disrupt the Service or its security

We reserve the right to suspend or terminate access to anyone who violates these Terms.

2. User Content

By submitting any content (e.g., prompts, messages, names, etc.) to our platform, you grant Figments Lab LLC a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display that content as necessary to provide the Service.

You are responsible for the content you submit and affirm that it does not violate any laws or rights of others.

3. Payments & Refunds

Certain features on HeySanta.com, such as Premium Santa Videos, require payment. By completing a purchase, you agree to the pricing displayed at checkout and acknowledge that all payments are final, except as described below.

Re-Renders and Refunds

If a Premium Santa Video fails to render correctly, does not include the information you submitted, or otherwise fails to meet reasonable delivery expectations due to a technical issue on our side, we will gladly re-render the video at no cost once the issue is reported.
If a re-render is not possible, we may, at our discretion, issue a full refund for the affected purchase.

To request a re-render or refund, contact us within 30 days of purchase at support@heysanta.com and include your order email and video link. Requests made after 30 days may not be eligible.

Other Refund Circumstances

We do not offer refunds for:

  • Changes of mind after a successful video is delivered
  • User input errors (e.g., typos or incorrect information)
  • Dissatisfaction with creative interpretation, tone, or delivery style

Refunds may also be denied in cases of suspected fraud, abuse, or misuse of the platform.

Dispute Resolution

If a chargeback or payment dispute is initiated, we will provide evidence of delivery and customer communication to assist in resolving the matter quickly and fairly.

4. Charity Commitment

Beginning October 1st, 2025, we will donate $0.05 per valid video generation to designated children’s charities, up to a total cap of $100,000 USD.

  • Only video generations created by unique, legitimate users will qualify.
  • Each user (identified by email address, IP address, or other reasonable identifiers) may contribute a maximum of 10 videos toward the donation total.
  • Spam, bot activity, or other abusive/fraudulent submissions will not be counted toward the donation total.
  • We reserve the right to verify and filter submissions at our discretion to ensure compliance with this commitment.
  • Videos generated by employees, partners, or contractors of Figments Lab LLC will be excluded.

Donation totals will be updated regularly and publicly displayed on our website.

5. Intellectual Property

All content on the Service, including video assets, scripts, images, branding, and software, is owned by or licensed to Figments Lab LLC. You may not reproduce, distribute, or create derivative works without our express permission.

6. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

We are not responsible for delays, damages, or losses arising from the use of the Service.

7. Limitation of Liability

To the fullest extent permitted by law, Figments Lab LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

8. Modifications

We may update these Terms at any time. If changes are material, we will notify you by email or via the website. Continued use of the Service constitutes acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of laws rules.
